Under his control, the New York City Corp. lost a lawsuit against the federal government over Republican-crafted welfare reform legislation that required state and local authorities to report illegal aliens to the Immigration and Naturalization Service.
The law stipulated that only citizens and certain legal immigrants were to receive food stamps and imposed financial penalties on states that did not verify the legal status of those applying for the stamps.
Giuliani said the final welfare reform bill, signed by President Clinton in 1996, was “anti-immigrant” and, “although I do think the bill does some good, in the end I believe it does more harm than good.”

On these grounds, Giuliani maintained that the welfare reform law violated the 10th Amendment of the Constitution.

As you may already know, I am a huge proponent of the 10th Amendment. I think it's the most abused part of the Constitution there is and needs to be enforced. This is not the way. The 10th Amendment is very simple and straightforward.
Amendment X
The powers not delegated to the United States by the Constitution, nor prohibited by it to the states, are reserved to the states respectively, or to the people.
What ths means is that if something is not specifically enumerated in the U.S. Constitution, then the federal government isn't allowed to do it.
A good example of this is education. Jimmy Carter started the Department of Education in the 1970's. Why? Up until then the states did perfectly fine teaching the children. It violated the 10th Amendment for him to use federal money on education. Yet he did. Now we are paying much more for education and the quality of the education is much worse than before the Department of Education was established. Why can't Johnny read? Because our leaders can't read. The 10th Amendment says we can't have a federal Department of Education. It's illegal.
If I was in charge, all the agencies and departments that violate the 10th Amendment would be abolished. They are illegal and usually do more harm than good. In a word, socialism.
Getting back to Rudy Giuliani, let's look at what he said.
Denying illegal immigrants of their food stamps violates the 10th Amendment. Um... no. You have it completely backwards.
a. Immigration is a federal issue. It is unreasonable for each state to have its own immigration system. Since people are applying for AMERICAN citizenship and not New York citizenship, that automatically makes it a federal issue. This is not a violation of the 10th Amendment.
b. Welfare and food stamps are not covered by the Constitution. Helping the homeless can be handled at the state and local level. Indeed, this was handled at the state and local level before Lyndon Johnson figured he would eliminate poverty. Did he succeed? No. The poverty rates increased since the Great Society. Food stamps are a clear violation of the 10th Amendment.
Rudy Giuliani was wrong twice in the same statement. Both ways, he was ignoring the Constitution (he can't read either) and siding with the socialist agenda.
Rudy Giuliani does NOT get the DrGadget conservative stamp of approval for the 2008 Presidential race. The only thing I ever liked about him was how he lowered the New York crime rate by implementing "broken window" policy. That worked. Everything else about him screams "Socialist!" How is this guy a Republican?
If he runs, I may have to consider voting for Hillary.
